Client was charged with various Felony and Misdemeanor counts for allegedly stealing drugs from her employer while working as a nurse. Due to relationships in the community, and a belief the Judge was facilitating the Commonwealth’s requests, the Shaw Law Group felt the assigned Judge was treating her unfairly. Upon Motion by the Shaw Law Group, the first assigned Judge was recused. This first Judge improperly picked his own replacement Judge and talked to him about the case, defeating the entire point of recusal to ensure a fair and impartial jurist. The Shaw Law Group moved for recusal of the second Judge in due to conflict and bias. The Common Pleas President Judge granted the Shaw Group’s Motion to recuse the second Judge and Ordered the AOPC to assign a third Judge. In the meantime, Felony charges were reduced to Misdemeanors.
